These Terms of Service (“Terms”) govern your access to and use of websites, digital services, content, and applications provided by 23p Technologies LLC (“we,” “us,” or “our”), including 23p.tech, ArcGym (arcgym.23p.tech), and related software (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Use of Services & Intellectual Property
All content, software, architecture diagrams, drill scenarios, and documentation published across the Services are owned by or licensed to 23p Technologies LLC and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Services for personal, non-commercial, educational, or professional development purposes. You may not reproduce, resell, reverse engineer, or redistribute our materials without prior written consent.
2. Acceptable Use
You agree to use the Services lawfully and responsibly. You agree not to:
- Interfere with, disrupt, or place an unreasonable load on our infrastructure or networks.
- Attempt to circumvent security controls, authentication systems, or rate limits.
- Use automated tools, scrapers, or bots to harvest data or abuse interactive endpoints.
- Submit unlawful, abusive, defamatory, or malicious content through any contact form or communication channel.
3. Educational & Informational Content Disclaimer
All materials, architecture patterns, FAQs, and drills are provided for educational and professional guidance purposes only. They do not constitute formal architectural warranties, legal advice, or official product endorsements from third-party platform vendors (such as Salesforce, MuleSoft, or AWS). Implementations should always be validated against your organization’s specific requirements and official vendor documentation.
4. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL 23P TECHNOLOGIES LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS OR $50.00 USD.
6. Indemnification
You agree to defend, indemnify, and hold harmless 23p Technologies LLC and its officers, directors, and employees from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Services.
7. Termination & Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Services, or terminate access for any user who violates these Terms, at any time without prior notice.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Fulton County, Georgia.
